Mulla’s Code of Civil Procedure has remained popular with the Bench and the Bar on the strength of its sheer quality and the high standard maintained by legal luminaries associated with its previous editions. The Code is divided into 2 parts – one containing the sections which are substantive provisions conferring power on courts and the other containing Orders which are detailed procedures for dealing with those powers.
The present edition – the seventeenth edition – has been divided into 4 volumes. Volume 1 contains the sections while volumes 2 to 4 contain the Orders. The Code of Civil Procedure was amended twice recently – once in 1999 and then in 2002.The amendments of 1999 and 2002 aimed at streamlining the provisions of the Code have been incorporated in the present edition in the light of the decisions of the Apex Court and various high courts. The important section 11 pertaining to res judicata has been extensively dealt with in 250 pages .Similarly in sections 9 and 10 besides updation of case law several new headings have been added. The term ‘substantial question of law’ and its various aspects, now part of several headings of section 100, have been dealt with exhaustively. The amendments in the various sections and orders are incorporated under their respective headings. The new headings which have been added should make the task of searching case-law easier. The book should prove useful for judges, lawyers, teachers, researchers and students. |
